CP2501: the underreporter inquiry that comes before a CP2000

A CP2501 asks the taxpayer to explain a mismatch between the return and third-party information returns before the IRS proposes any tax. This page explains when the Automated Underreporter program chooses an inquiry over a CP2000, how to answer it, and why an unanswered CP2501 turns into a CP2000B.

What the notice means

IRM 4.19.3.21.1 states the purpose plainly: “The CP 2501 is the notice sent to a taxpayer to obtain additional information prior to issuing a CP 2000.” Nothing has been proposed yet. The IRS page for the notice says it explains the mismatch and the information used, and that the notice “isn’t a bill, but you must respond.”

That difference matters. A CP2000 is a proposed assessment with a consent form; the CP2501 asks for an explanation first. IRM 4.19.3.7 tells tax examiners that a CP2501 “may provide better customer service since it is an inquiry instead of a proposal of assessment.” A good reply can end the case with no proposed tax at all.

Why the client got it

Like the CP2000, the CP2501 comes out of AUR matching of returns against information returns (see CP2000). The examiner chooses a CP2501 instead of a CP2000 when IRM 4.19.3.7 requires it or when an inquiry makes more sense. The required situations include:

  • Underreported income of $100,000 or more.
  • Questionable underclaimed withholding or additional Medicare tax withholding that would produce an overall refund.
  • Cases that would produce an overall refund because of underreported income.
  • Underclaimed excess Social Security tax on electronically filed returns.
  • Certain Form 8615 (kiddie tax) computations, and conduit income cases where several information returns share an on-file date and none is reported.

There is a timing catch: “The system parameters are set by HQ to stop issuing CP 2501 at a certain point in the AUR processing year.” (IRM 4.19.3.7) Late in the cycle, the same facts may produce a CP2000 directly.

Deadlines and what happens if they pass

The reply date is printed on the notice. If the taxpayer calls for more time, IRM 4.19.3.23.2.5 tells the assistor: “Inform the taxpayer that they have been granted a 15-day extension.” The assistor is to warn that if the reply is not received within 45 days of the notice date a subsequent contact will follow, and no systemic extension is granted.

A written extension request on a CP2501 is handled differently from one on a CP2000. Under IRM 4.19.3.23.9.3, AUR answers it by issuing a CP2000 with an explanatory paragraph. In practice, asking for more time in writing moves the case to the proposal stage.

If there is no reply, AUR issues a CP2000B, which IRM 4.19.3.21.2 defines as a “CP2000 issued after the CP2501 where the taxpayer didn’t respond.” From there the CP2000 clock applies, ending in a CP3219A notice of deficiency if still unresolved.

How to respond

  1. Pull the wage and income transcript for the year and match each listed information return to the return as filed. See reading transcripts.
  2. Put authorization in place: the response form's authorization section covers this notice only; a Form 2848 covers representation generally.
  3. If the income was reported, show where: the line, schedule and any total that includes it. Publication 5181 asks for a breakdown when an amount is inside a larger total.
  4. If the taxpayer disagrees, the IRS page lists what to send with the signed response form: a signed statement explaining the disagreement, supporting documents, expenses related to the income that may reduce tax, and an amended return or forms if the notice asks for them, marked “CP2501” at the top.
  5. If the taxpayer agrees, select the agree option and sign. For joint filers, the IRS page asks for both signatures. AUR then computes the tax and sends a CP2000 (Publication 5181). IRM 4.19.3.23.7 treats a signed CP2501 as an agreed reply only when the taxpayer supplies a complete, accurate tax computation.
  6. Send it by upload, fax to the campus number on the notice, or mail to the address on the notice, and keep proof of the date.

A CP2501 reply that resolves the mismatch avoids a proposal, the accuracy-related penalty computation on that proposal and the statutory notice track. It is the cheapest point in the AUR process to fix a reporting difference.

What the IRS does next

Publication 5181 describes the outcomes: the IRS may accept the return as filed and send a letter; if the taxpayer agreed, it computes the tax and sends a CP2000; and if it does not accept the documentation, it sends a CP2000 showing the proposed tax. A reply that changes the amount but still needs agreement produces a CP2000A (IRM 4.19.3.21.2). From that point the case follows the CP2000 procedures, including a possible notice of deficiency and Tax Court petition.

  • CP2000: the proposal that follows if the CP2501 does not resolve the case.
  • CP2057: an informational notice that income may be missing.
  • CP3219A: the statutory notice of deficiency from AUR.

Questions practitioners ask

Is a CP2501 less serious than a CP2000?

It is earlier. No tax is proposed and there is no consent form to sign. But the same AUR case continues to a CP2000B if there is no reply, so the deadline should be treated as real.

Why did the client get a CP2501 when others get a CP2000?

IRM 4.19.3.7 requires a CP2501 for certain cases, including underreported income of $100,000 or more and mismatches that would create an overall refund. Examiners may also choose it when an inquiry gives better service.

How do we get more time?

By phone the IRS grants 15 days (IRM 4.19.3.23.2.5). A written extension request to a CP2501 causes AUR to issue a CP2000 with an explanatory paragraph (IRM 4.19.3.23.9.3).

Should we file an amended return?

Only if the notice asks for one or the taxpayer has other changes to report. If one is sent, write CP2501 at the top and send it with the response form, as the IRS notice page instructs.
